Lessons from Recent Fiduciary Cases

with Dana Fitzsimons

Today, Dana Fitzsimons, partner with McGuire Woods, LLP, a well respected author and speaker on trustee fiduciary duties, joins Randy Zipse, JD, CPA, to discuss some recent developments in the area of trust case law. Topics covered include the Uniform Trust Act, the Uniform Prudent Investor Act, and even a recent US Supreme Court case. The issues of litigation include a trustee's duty to report to beneficiaries, statutes of limitation, the limitations on the attorney client privilege in a trust context, and, strangely, a wife's adoption of her ex-husband...you have to hear it to believe it...and a few cases involving trustee liability for exercising their investment and distribution discretion.
